PROBLEMS AND APPROPRIATE LEGAL MEASURES FOR THE USE OF SELF-DEFENSE BY POLICE OFFICERS IN EMERGENCY RESPONSE.

Abstract

The purpose of this article is to study the guidelines and meaning of lawful protection of police officers and to study the problems of police officers regarding self-defense in emergencies, in critical situations that may cause danger to the body or life. The methodology is the research of documents and information obtained from interviews. The results of the study found that the law on self-defense that applies to the operations does not specifically provide for it. There is Section 68 of the Criminal Code, which is the same law that governs the self-defense of ordinary people. Moreover, the above principles can be interpreted widely thus its use must be based on uncertain court judgments. Even though the Criminal Procedure Code, Section 83, paragraph 3, or the regulations regarding arrest do not change the results. Therefore, it shows that the existing law does not facilitate the work of the police because it does not correspond to the reality of the situation. The results of international research studies and the opinions of human dynamics experts regarding the ability of police officers to perform in stressful emergencies appear to be different from the Thai legal perspective. As a result, when police officers use force in self-defense, they receive undue damage because from the law viewpoint is considered an act of excessive severity while the guidelines of foreign laws, such as the laws of Minnesota, United States, are more consistent and facilitate the work of police officers. So, if Thailand develops appropriate laws while simultaneously controlling the use of that power, it will make the use of force by police officers more efficient and verifiable. Police officers will have morale in performing their duties in maintaining peace and order for the people while the public will have confidence in the police officers' duties performance.

บทความเรื่องนี้มีวัตถุประสงค์เพื่อศึกษาแนวทางและความหมายของการการป้องกันโดยชอบด้วยกฎหมายของเจ้าหน้าที่ตำรวจและศึกษาปัญหาของเจ้าหน้าที่ตำรวจเกี่ยวกับการใช้กำลังการป้องกันตัวในการระงับเหตุฉุกเฉิน ในสถานการณ์ที่คับขันที่ต้องเผชิญกับภยันตรายอันอาจก่อให้เกิดภยันตรายต่อร่างกายหรือชีวิต โดยการวิจัยทางเอกสารและลงพื้นที่เก็บข้อมูลโดยการสัมภาษณ์ ผลการศึกษาพบว่า การที่กฎหมายที่ใช้บังคับนั้นเป็นไปตามประมวลกฎหมายอาญา มาตรา 68 อันเป็นกฎหมายเดียวกันกับที่ใช้บังคับในการป้องกันตัวของบุคคลทั่วไป อีกทั้งหลักการดังกล่าวยังมีการตีความได้โดยกว้าง ทำให้การนำมาใช้ต้องอ้างอิงตามคำพิพากษาของศาลซึ่งยังไม่มีความแน่นอน แม้มีประมวลกฎหมายวิธีพิจารณาความอาญา มาตรา 83 วรรค 3 หรือ ระเบียบเรื่องการจับกุม ก็ไม่ทำให้ผลเปลี่ยนแปลงไป เห็นได้ว่ากฎหมายที่มีอยู่ไม่เอื้ออำนวยต่อการปฏิบัติงานของเจ้าหน้าที่ตำรวจ เนื่องจากไม่สอดคล้องกับความเป็นจริงของสถานการณ์ที่เกิดขึ้น จากการศึกษางานวิจัยต่างประเทศและความเห็นของผู้เชี่ยวชาญด้านพลวัตของมนุษย์ ในเรื่องความสามารถและประสิทธิภาพของเจ้าหน้าที่ตำรวจในสถานการณ์ฉุกเฉินที่มีความกดดันนั้น ปรากฏข้อเท็จจริงที่แตกต่างจากมุมมองทางกฎหมายของไทย ส่งผลให้เมื่อเจ้าหน้าที่ตำรวจไทยใช้กำลังในการป้องกันตนเอง แต่กลับได้รับความเสียหายเกินควร เนื่องจากกฎหมายถือเป็นการกระทำรุนแรงเกินกว่าเหตุ ในขณะที่แนวทางของกฎหมายต่างประเทศ เช่น กฎหมายของมลรัฐมินนิโซต้า ประเทศสหรัฐอเมริกา กฎหมายสอดคล้องกับสถานการณ์และเอื้ออำนวยต่อการปฏิบัติงานของเจ้าหน้าที่ตำรวจมากกว่า ดังนั้น หากประเทศไทยพัฒนากฎหมายสำหรับเจ้าหน้าที่ตำรวจโดยเฉพาะและมีความชัดเจน ในขณะที่มีการกำหนดให้ควบคุมดูแลการใช้อำนาจไปด้วย จะทำให้การใช้กำลังของเจ้าหน้าที่ตำรวจมีประสิทธิภาพและสามารถตรวจสอบได้ เจ้าหน้าที่ตำรวจเกิดขวัญและกำลังใจในการปฏิบัติหน้าที่ในการรักษาความสงบเรียบร้อยให้กับประชาชน ขณะเดียวกันประชาชน ก็เกิดความเชื่อมั่นในการปฏิบัติหน้าที่ของเจ้าหน้าที่ตำรวจ
